Terms & Conditions of use for the Social-Sexual Education Project.
The Social-Sexual Education Project is funded through the Mental Health Services Act in partnership with the Department of Developmental Services. The North Bay Regional Center is solely responsible for the content of the Social-Sexual Education Project and this website. The Department of Developmental Services has not developed, reviewed, endorsed, or approved the contents of the Project or the website, and is not a party to these terms and conditions.

ACCEPTANCE OF TERMS AND CONDITIONS

The following is a Service Agreement that is a legally binding agreement, which shall govern your use of this website and the relationship between the site’s users and others who may interact or interface with the Social-Sexual Education Project and its educational programs and the developers of this website and the North Bay Regional Center. This Agreement shall become effective upon its first date of publication as a website accessible through the internet.

Under these Terms and Conditions, the Social-Sexual Education Project, under the auspices of the North Bay Regional Center, and/or its licensors own all rights to the intellectual property and material contained in this Website, and all such rights are reserved. Limitation of Liability.

Restrictions.
You are expressly and emphatically restricted from all of the following:

Indemnification.
You hereby indemnify to the fullest extent the developers of the Social-Sexual Education Project and the North Bay Regional Center, or any of its officers, directors, and employees from and against any and all liabilities, costs, demands, causes of action, damages, and expenses (including reasonable attorney’s fees) arising out of or in any way related to your breach of any of the provisions of these Terms and Conditions.
Severability.
If any provision of these Terms and Conditions is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms or Conditions unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.
Variation of Terms.
The developers of the Social-Sexual Education Project, following consultation with the North Bay Regional Center, are permitted to revise these Terms and Conditions at any time as it sees fit, and by using this website you are expected to review such Terms and Conditions on a regular basis to ensure you understand all terms and conditions governing use of this website.
Assignment.
The North Bay Regional Center shall be permitted to assign, transfer, and subcontract its rights and/or obligations under these Terms and Conditions without any notification or consent required. However, you, on the other hand, shall not be permitted to assign, transfer, or subcontract any of your rights and/or obligations under these Terms and Conditions.
Governing Law & Jurisdiction.
These Terms and Conditions will be governed by and construed in accordance with the laws of the State of California and you submit to the non-exclusive jurisdiction of the state and federal courts located in California for the resolution of any disputes.
Entire Agreement.
These Terms and Conditions, including any legal notices and disclaimers contained on this website, constitute the entire agreement between the developers of the Social-Sexual Education Project and the North Bay Regional Center, including any of its officers, directors, and employees, and you in relation to your use of this website, and supersede all prior agreements and understandings with respect to the same.
